Proposed Parking Local Law

An internal review of the current Shire of East Pilbara Parking Local Law has identified a number of out dated rules that limit the ability of Shire officers from enforcing car parking rules at Newman Airport.

To address these issues, a new Parking Local Law has been proposed.

The proposed local law will improve access to free short term carparking at Newman Airport for residents and visitors, by enhancing the powers of Shire rangers to enforce time limits on the use of the short term carpark, which has been routinely filled with returned rental vehicles and other work vehicles for sometimes weeks at a time.

Other measures to be introduced by the new Parking Local Law include the use of electronic parking technology to enable more convenient payment options and parking permits at Newman Airport. For example new rules that enable the Shire to set zones where parking fees are paid by electronic means only, via a mobile device through an app such as ‘PayStay’. This would enable the Shire to introduce pay by phone only parking zones at Newman Airport, without the need to install and then maintain expensive ticket machines.

Another initiative included in the proposed parking local law, is to provide residents (in residential areas) the ability to control parking on the verge at the front of their own property.

A summary of proposed improvements is listed in the following table:

Limiting the operation of clause 3.2 to the payment of fees in a fee-paying zone that is not in a parking station. The payment of fees in a parking station is governed by clause 4.2.

Amendments to the pay by phone provisions (in clause 3.2(2)(c) and in other corresponding provisions) to be consistent with the pay by phone process.

Inclusion of a new section that deals with a ‘Construction Site’.

Limiting clause 7.11 to prohibitions against leaving a vehicle in a public place – with the Shire’s removal and impounding powers to be exercised under regulation 29 of the Local Government (Functions and General) Regulations 1996.

Amendments to the prescribed offences in Schedule 1, to increase infringement amounts.

Schedule 1

Amendments to Forms 2 and 3 in Schedule 2 to be consistent with the recent amendments to the Fines, Penalties and Infringement Notices Enforcement Act 1994.

Schedule 2

The purpose of this local law is to provide a statutory framework to enable the Shire to regulate the parking of vehicles within the district and provide for the management and operation of parking facilities under the Shire’s care, control and management.

The effect of this local law is to stipulate that a person parking a vehicle within the parking region is to comply with the provisions of the local law.

A copy of the proposed Shire of East Pilbara Parking Local Law may be inspected or obtained from the Shire’s website www.eastpilbara.wa.gov.au or from the Shire offices at Cnr Kalgan and Newman Drives, Newman or 12 Francis Street, Marble Bar, between 8.30am and 4.00pm, Monday to Friday.

Submissions may also be hand delivered to the Shire’s administration offices in Newman and Marble Bar, and to the Newman Library between 8.30am and 4.00pm, Monday to Friday and to Nullagine Library on Wednesdays between 10.00am and 2.00pm.

Submission must be received by the Shire of East Pilbara by 4.00pm on Monday, 3 June 2024.
